The “Zero Return” Standard: 5 Attempts Minimum

Most process servers try three times and quit. We do more. Our policy is a minimum of 5 attempts on different days and times (including evenings and weekends).

Why do we do this? Because returning a file as “Unserved” forces you to bring an application for Substitutional Service. In Alberta, this application consumes valuable time and legal fees. We put in the extra work upfront to secure personal service whenever possible.

What is the Small Claims limit in Alberta?

As of August 1, 2023, the limit for the Alberta Court of Justice (Civil) is $100,000. This increased limit means more significant matters are being heard in this court, making professional service even more critical.

How do I serve a corporation in Alberta?

Under Section 22 of the Rules of Court, you can serve a corporation by leaving the document at its registered office, serving an officer/director personally, or sending it by recorded mail to the registered office. We recommend personal service at the registered office to ensure immediate effect.

When can I apply for Substitutional Service?

If personal service is impractical, you may apply for a Substitutional Service Order. However, the court requires evidence that you have made “reasonable efforts” to locate and serve the defendant. Can I serve documents by email in Alberta?

Generally, commencement documents (like a Statement of Claim) must be served personally. Electronic service (email/text) is usually only permitted if you have a specific court order allowing it (Substitutional Service) or if the other party’s lawyer has explicitly agreed to accept service electronically.
