What is a Process Server

A Process Server is a professional responsible for delivering legal notice to a party involved in a court case or legal proceeding. This formal notice, known as “service of process,” ensures that all parties are properly aware of a legal action against them, allowing them a fair opportunity to respond.

Notice is typically provided by presenting the individual or entity with official court documents, such as a Statement of Claim, Summons, or other legal papers. The rules of civil procedure in each province dictate exactly how these documents must be served. Some documents require personal, hand-to-hand delivery, while others may be served upon another adult at the person’s residence.

The Role of a Process Server

The role of a professional process server is critical to the integrity of the justice system. They are responsible for:

  • Following all legal rules and procedures for service in their specific jurisdiction.
  • Acting as a neutral third party in the delivery of documents.
  • Completing a sworn Affidavit of Service, a legal document that proves to the court that the documents were served correctly.
