We are in court on a daily basis conducting filings, issuing and doing research into files for you across Canada.
One of the major problems that we encounter are files that are being rejected for a variety of reasons.
This is expected and not a problem as we strive to get the proper answers for you from the court so you can correct your documents and then re-submit them to us for filing.
Each file has at times its own challenges, they can be very complex, we understand this, some are files that have been taken over from old counsel and need a lot of work!
However, what we are finding is at times you our client are not advising us of “special” instructions or circumstances surrounding a file, which could be an endorsement by a judge on the file that has not been told to us.
What then happens is we show up at court to complete your filing and it is rejected by the clerk for some specific reason.
We advise you of what the clerk said and then we find out something else going on that was not communicated to us and then from us to the clerk.
This then requires another visit to the court to complete the filing, which is fine by us, but if we had been told about it upfront it would save a lot of headaches for all!
So the moral of this story is communication.
